- The rapid changes to COVID control. What Biden’s federal plan has in store for employers and how you should adjust your safety and shut-down procedures now.
- Employee leave. From immediate extension of FFCRA to a longer push for national paid leave, it’s time to prepare your leave policies for revisions. FFCRA has been largely successful because employers get 100% tax credits for the leave paid out. Will Congress finally pass a comprehensive leave law with a similar tax scheme?
- Agency transitions. New leadership in the DOL and NLRB will certainly lead to new regulations you don’t want to get blind-sided by.
- Gender and pay parity. With Janet Yellen at Treasury, Neera Tanden at the office of Management and Budget and Cecilia Rouse at the White House Council of Economic Advisers, expect a push to close the pay gap once and for all. That’s sure to include tighter rules for federal contractors.
- Immigration. Executive orders are likely to be reversed. What does this mean for your DACA employees and those on visas? Plus, expect an increase in efforts to hold employers responsible for employing undocumented workers rather than punishing the workers themselves.
- Minimum wage. Expect a massive administration push for a ‘livable’ $15 per hour minimum. What power will the federal government have to change wage laws nationally?
- Worker protection. Biden’s administration agenda is pro-worker. That means new protected classes, stricter (and pricier) enforcement of discrimination and harassment plus support of unionization.

Anniken has served as a professor at Penn State University, where she taught business law and HR management, and she directed the Legal Studies Program at Wilson College. Her legal career includes representing government units in discrimination and other employment law cases and representing school districts in labor negotiations.
