Navigating USERRA and military leave can be more complicated than you realize
The Uniformed Services Employment and Reemployment Rights Act (USERRA) requires employers to provide job-protected time off when a member of a military service participates in weekend and other training sessions. That’s manageable for most employers. But USERRA doesn’t stop there, and that’s where things get tricky for employers.
Not every case of military leave is clear-cut
When the military calls up reservists for active duty, the service members also have job-protected leave rights—even if they’re gone for years. The same applies if an employee signs up for military service for the first time while already working full- or part-time for you.
Beyond that, what counts as military service might be broader than you think. For example, Congress recently classified FEMA Reserve Corps as protected by USERRA. In fact, even if you don’t have a member of the military on staff, what happens on active duty may impact you. That’s because the FMLA provides time off for a service member’s family for a long list of reasons related to military service.
Don’t leave compliance up to chance
Employers have strict time requirements for reinstating a service member returning from active duty, and it has to be done right. That means a plan is needed, and you can’t leave the interpretation of tricky parts of the law up to chance.
