FMLA Intermittent Leave: Compliance Workshop

Intermittent Leave

Tired of unpredictable FMLA call-offs? Here’s how to handle intermittent leave.

In this 75-minute workshop, you’ll discover how to:

  • Answer any questions about leave. One wrong employee-leave decision can trigger a career-crushing lawsuit.
  • Avoid intermittent FMLA mistakes. Managing those small bites of leave is the hardest part of the FMLA.
  • Treat intermittent leave as a right. But employers have rights, too. Learn how to manage intermittent leave to your advantage.

“Intermittent leave is the single most serious area of friction between employers and employees seeking to use FMLA leave.” — U.S. Department of Labor

Some of HR’s most thorny, legally risky situations involve employees’ use (and abuse) of FMLA leave taken in small bites. The detail and timing necessary to administer intermittent leave can confuse even the most seasoned HR professionals. Also, because employees are becoming well versed in the FMLA game, your organization is paying the price. It’s up to you to know the law—and your CEO will expect it.

On Wednesday, March 6, find out how to prevent and correct FMLA compliance problems and effectively manage all types of FMLA intermittent leave issues, including properly certifying the need for intermittent leave so it’s only used for its intended purpose and not turned into personal leave on demand. Plus, learn how to coordinate FMLA intermittent leave used during pregnancy and time off under the Pregnant Workers Fairness Act to minimize disruption and avoid double-dipping.

Our promise: By the end of this webinar, you will feel much more comfortable and confident balancing workplace needs with your legal FMLA obligations.

Webinar Agenda

  • Confidently handle every intermittent FMLA question thrown at you.
  • Correctly use the tools of compliance to address unscheduled and intermittent leaves (certifications, call-in rules, attendance procedures and more).
  • Learn what to do when the FMLA call-offs exceed the intermittent leave certification you have on file.
  • Manage the practical FMLA intermittent issues, not just the legal ones.
  • Leverage your follow-up powers. Know when you can contact an employee’s doctor about the need for leave … and request a second opinion.
  • Both the FMLA and the PWFA allow pregnant workers short bursts of unscheduled leave. Learn how to track both concurrently.
  • Learn lessons from recent court rulings. They lay out a path for the best (and worst) steps to complying with intermittent leave laws.
  • Identify the key questions you should be asking each and every time an employee seeks leave.
  • Understand “real world” FMLA scenarios. We’ll explain how to manage the common FMLA problems you face daily, including reining in intermittent leave abuse with strict call-off compliance, when intermittent leave is for a family member’s chronic illness and how to avoid other potential legal pitfalls associated with leave (such as the Americans with Disabilities Act, PWFA and workers’ compensation).
