  • Workday rules. Learn how to spell out what you expect – including how to dress, how to behave with coworkers and customers, when to arrive and when to leave – so there’s no confusion. Get specific with examples.
  • Time off. Make it easy for employees to meet your expectations while building in some flexibility. Plus, understand a clear way to integrate FMLA and your PTO policies, including setting the rules for prior approval and emergency call-offs.
  • Employment policies and employee conduct. You need a fair and equitable disciplinary policy. Learn exactly what must be included. Will it be a progressive disciplinary process with opportunities to wipe out past discipline? Can and should you include elements of zero tolerance?
  • Workplace issues. Employees will have conflicts with coworkers, customers and supervisors – now more than ever. Create simple policies that manage that conflict and work towards creating an overall positive workplace without triggering DOL, EEOC or NLRB scrutiny. Plus, make sure employees understand your harassment prevention and control policies so you have a chance to respond before you’re sued.
  • Communication and buy-in. Steps to take to make sure your policies are clearly communicated and understood, and that your employees commit to them.

Anniken Davenport is a noted employment law attorney and the editor of the HR Specialist: Employment Law newsletter series. She has authored several books, including Bullet-Proof Your Employee Handbook and Overtime & Other Tricky Pay Issues, published by HR Specialist. She is the co-author of the upcoming Labor & Employment Law for the 21st Century by Prentice Hall. Anniken has served as a professor at Penn State University, where she taught business law and HR management, and she directed the Legal Studies Program at Wilson College. Her legal career includes representing government units in discrimination and other employment law cases and representing school districts in labor negotiations.
